Mr.Vasum, learned Government Advocate and Mr.James, learned counsel for respondents. In WP(C) No.184 of 2023 petitioner challenged the suspension order and in rest of writ petitions petitioner has challenged the formation of Management Committee and appointment of private respondent as Headmaster. Mr.James, learned counsel for petitioner submits that tenure of Management Committee under challenge has already expired and private respondent also retired on superannuation and hence, WP(C) Nos.376 of 2021 and WP(C) No.66 of 2019 have become infructuous by efflux of time and these may be closed. Mr.Vasum, learned Government Advocate also adopted the submission of Mr.James. Mr.Mohendro, learned counsel for petitioner fairly submits that WP(C) Nos.376 of 2021 and 66 of 2019 may be closed as tenure of Management Committee under challenge and appointment of private respondents as Headmaster do not survive as on date. However, he submits that WP(C) No.184 of 2023 challenging suspension order passed by erstwhile Management Committee is still surviving as this Court has upheld maintainability of writ petition. In the circumstance, WP(C) No.376 of 2021 and WP(C) No.66 of 2019 are closed as infructuous. List WP(C) No.184 of 2023 and MC (WWP(C)) No.22 of 2023 be listed for hearing on 31.8.2026.
