Pundir, learned Dy.A.G. with Mr. Sushil Vashisth, learned Standing Counsel for the State- respondents. 3. Petitioner is serving as Medical Officer (Ayurved) in the Department of Ayurveda, Yoga & Naturapathy, Unani, Siddha and Homeopathy (AYUSH). He has challenged the order of transfer passed on 02/03.01.2023. By said order, petitioner was transferred from Govt. Ayurvedic Hospital, Muyalgaon to Govt. Ayurvedic Hospital, Kathood within the same district. 4. A Co-ordinate Bench of this Court had passed interim order on 16.02.2023 in favour of petitioner thereby staying the effect of impugned order dated 03.01.2023 qua petitioner. 5. Learned State Counsel submits that on 09.02.2024, one Dr. Rajeev Kumar was posted in place of petitioner at Govt. Ayurvedic Hospital, Kathood, and petitioner was relieved to serve at his original place of posting i.e. Govt. Ayurvedic Hospital, Muyal Village, Tehri Garhwal. He submits that since petitioner has gone back to the place where he was earlier serving, therefore, challenge thrown to the transfer order dated 02/03.01.2023 do not survive. Similar statement is made in paragraph no.10 of the counter affidavit filed on behalf of respondent nos.2 and 3. 6. The above submission made by learned State Counsel is not disputed by learned Counsel for the petitioner. 7. Having regard to the facts and circumstances of the case, we do not find any reason to interfere with the impugned transfer order. The writ petition fails and the same is dismissed. 8.
