In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 and seeking regular bail for the Applicant – Jagdish Chandra Punetha, who has been accused in Case Crime No.109 of 2021, at Police Station Kotwali Pithoragarh, dated 08.06.2021, under Sections 420, and 506 of IPC, (now the charge sheet has been submitted and the cognizance has been taken under Section 420, 120B, 406, 506 IPC and 3/21, 5/23 of BUDS of Act). 5. Heard learned counsel for the Applicant as well as learned State counsel. Perused the record. 6. Learned counsel for the applicant submits that the Applicant has been falsely implicated in the present case and is in judicial custody since 14.11.2025. 7. That the learned counsel for the applicant submits that the present applicant was neither the partner, signatory nor was the beneficiary in the firm. 8. Considering the overall facts and circumstances of the case and the fact that all other person who have allegedly received money have also been granted bail and period of incarceration. The present Applicant has made out a case for bail at this stage. 9. Accordingly, bail application is allowed. It is directed that the Applicant–Jagdish Chandra Punetha S/o Shri Chandra Prakash Punetha, who has been accused in Case Crime No.109 of 2021, dated 08.06.2021, under Sections 420, and 506 of IPC, (now the charge sheet has been submitted and the cognizance has been taken under Section 420, 120B, 406, 506 IPC and 3/21, 5/23 BUDS of Act) at Police Station Kotwali Pithoragarh, be released on bail on furnishing a personal bond with two sureties each in the like amount to the satisfaction of the concerned court.
