OMP(M) 221 of 2023 The present application has been filed for condonation of delay in filing the present appeal. It has been averred in the application that the impugned judgment was passed by the learned District Judge, Kangra on 07.01.2023. The certified copy of the impugned judgment was applied by the learned counsel for the applicant and the same was obtained on 09.02.2023. The copy of the judgment was sent to the higher authority in order to seek the opinion for filing the appeal against the impugned judgment passed by learned District Judge. The legal opinion and the copy of the judgment was sent to the office of learned Deputy Solicitor General, H.P. for filing the appeal. On 08.04.2023, the legal opinion of the learned Deputy Solicitor General was received and thereafter, after consulting the matter with the higher authority of the applicant, draft of the appeal was presented and the learned Deputy Solicitor General directed the officials of the applicant to get the appeal drafted from the standing counsel of Union of India at Dharamshala. The applicant approached the counsel at Dharamshala for vetting the draft and thereafter after the vetting of draft, appeal in question was filed. It has been averred in the application that the delay in filing the appeal is neither intentional nor willful, but the same has occurred due to unavoidable circumstances. As per report of the Registry, there is delay of 80 days in filing the present appeal. In view of the averments as made in the application, especially paras 2 and 3, there are reasonable and plausible reasons for condonation of delay in filing the appeal. Consequently, in view of the averments as made in the application, which is duly supported by an affidavit and in view submissions as made by learned Deputy Solicitor General of India, the present application is allowed and delay in filing the appeal is condoned.
