1. This hearing has been done through hybrid mode. 2. By the way of the present petitions filed under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the ‘CrPC’), the petitioner is seeking quashing of FIR No. 0423/2021, registered at Police Station Patel Nagar, for the offences punishable under Sections 328, 376-D, 506 of The Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), Final Report Bearing No. 81620422104221042301/2021 dated 23.10.2021 for the aforesaid offences and order dated 13.01.2022 passed by learned Additional Chief Metropolitan Magistrate, Tis Hazari Courts, new Delhi issuing summons to the petitioner in SC No.157/2022 titled ‘State v. Ram Chawla & Ors.’ and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. Learned APP for the State vehemently opposes the prayer for quashing of the FIR and submits that the allegations levelled in the FIR are serious in nature. 5. The petitioner who is present in the Court and respondents no. 2, who is present though video conferencing before this Court, have been identified by their counsel and Investigating Officer concerned. 6.
Briefly stated, The FIR was registered on the complaint of Respondent No.2 alleging that on 14.08.2021, after she visited the accused person's office in connection with a prospective employment opportunity, she was allegedly This is a digitally signed order. intoxicated, sexually assaulted and criminally intimidated by the accused persons. During investigation, respondent No.2’s statements were recorded under Sections 161 and 164 Cr.P.C.; in her statement under Section 164 Cr.P.C. dated 25.08.2021, she retracted the allegations made in the complaint and stated that the incident alleged in the FIR had not occurred. The police thereafter filed the chargesheet for the aforesaid offences, pursuant to which the learned Trial Court, vide order dated 13.01.2022, took cognizance and issued summons to the accused persons in SC No.157/2022 titled State v. Ram Chawla & Ors. Supplementary chargesheets were subsequently filed, including on the basis of the FSL reports. The accused persons approached this Court by way of the present connected petitions seeking quashing of the FIR and consequential proceedings. 7. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has settled the case, out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 8. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.
Accordingly, FIR No. 0423/2021, registered at Police Station Patel Nagar for the offences punishable under Sections 328, 376-D, 506 of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed.
