CMP(M) No. 1746 of 2023 Applicants-State has filed the instant application under Section 5 of the Limitation Act for condonation of 69 days of delay in filing the accom- panying first appeal. 2. In Paras 2 to 6 of the application, the applicants have explained the reasons for the delay, which appear to be convincing and reveal sufficient cause. 3. Upon listing of the application, Ms. Kamlesh Kumari, Advocate, appearing for respondents No.3 and 4 does not opposes the prayer made in the application. Other respondents 1(a) to 1(e) and 2(i) to 2(iii) are already ex parte. Application is supported by an affidavit also. 4. Taking into account, the averments made in the application and the fact that the application is not opposed by respondent’s Counsel, application is allowed and delay of 69 days of filing the accompanying appeal is condoned.
