By way of the present petition filed under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as the ‘CrPC’), the petitioners seek quashing of FIR No. 598/2020, registered at Police Station Mehrauli, District South, Delhi for the offences punishable under Sections 279/337/304A of the Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’) and 146/196 of the Motor Vehicles Act, 1988 (hereinafter referred to as the ‘MV Act’) along with all consequential proceedings arising therefrom, on the basis of an amicable settlement arrived at between the parties. The Petitioner and Respondents no. 2-6 are present before this Court and have been duly identified by the Investigating Officer (IO) concerned. 5. Briefly stated, that on 10.09.2020, FIR No. 598/2020 was registered at Police Station Mehrauli, District South, Delhi under Sections 279/337/304A of the IPC and Sections 146/196 of the Motor Vehicles Act, 1988, against the petitioner. Upon completion of the investigation, the chargesheet was filed and the proceedings are pending before the learned Metropolitan Magistrate, South District, Saket Court, New Delhi. 6. During the pendency of the proceedings, the parties amicably resolved their disputes vide Memorandum of Settlement dated 05.06.2023 for a total sum of Rs.4,15,000/-. Out of the said amount, Rs.4,00,000/- was paid on 13.05.2023 and the balance amount of Rs.15,000/- was agreed to be paid at the time of quashing of the FIR. Respondents no. 2 to 6 have stated that they have no surviving grievance against the petitioner and have no objection to the quashing of the FIR and the proceedings emanating therefrom. 7. Learned counsel for the petitioner submits that, in terms of the Memorandum of Understanding dated 05.06.2023, the parties agreed to settle all their disputes for a total sum of Rs. 4,15,000/-. He submits that the remaining amount has been handed over to the respondents today in Court in cash. It is further submitted that, with the said payment, the terms and conditions of the settlement stand fully complied with and nothing further remains to be paid by either party under the settlement. 8. On a query made by this Court, respondents no. 2-6 who have been duly identified by the IO, have categorically stated that they have entered into This is a digitally signed order. The Order is downloaded from the DHC Server on 11/08/2026 at 11:24:54 a compromise, vide Memorandum of Understanding dated 05.06.2023, out of their own free will and without any pressure, coercion or threat. Therefore, they have no objection if the present FIR is quashed. 9. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR concerned. 10. Accordingly, FIR No. 598/2020, registered at Police Station Mehrauli, District South, Delhi, for the offences punishable under Sections 279/337/304A of IPC, and 146/196 of the MV Act and all consequential proceedings emanating therefrom, are hereby quashed. 11. The present petition, along with pending application(s), if any, stands disposed of. 12. Copy of the order be communicated to the concerned Trial Court for necessary action and compliance. 13.
