Mr. Bhupinder Ghai, learned counsel (through V.C.) with Mr. Aakib Ahmed, learned counsel for the respondent. 4. These are two petitions, one is WPCRL No. 1024 of 2023 wherein the petitioner Shaurya Gupta praying for quashing of FIR bearing FIR No. 93 of 2023. Another petition under Section 482 Cr.P.C. by the parents of the petitioner of WPCRL No. 1024 of 2023 wherein the entire proceeding of Criminal Case No. 7534 of 2023 arising out of the FIR dated 01.05.2023 which is subject matter of WPCRL No. 1024 of 2023 is being sought to be quashed. In WPCRL No. 1024 of 2023 interim protection was granted till the conclusion of the investigation and subsequent thereto in C482 application, proceedings was stayed. 5. Now, IA No. 10 of 2026 has been moved in WPCRL No. 1024 of 2023 wherein it is contended that both the parties entered into compromise on 21.09.2025 to get divorce by mutual consent and towards permanent alimony Rs. 10 lakhs is fixed. Based on this compromise, divorce petition was filed under Section 13B of Hindu Marriage Act to seek divorce by way of mutual consent and on 23.02.2026, divorce decree has been passed. 6. Now both the parties are present through V.C.. The respondent/complainant –wife submits that out of the agreed amount towards permanent alimony she already received Rs. 6 lakhs and the remaining amount was agreed to be paid on closing of present proceedings. 7. Counsel for both the parties also joined the proceeding through V.C., and counsel for the petitioner handed over a demand draft for an amount of Rs. 4 lakhs to the counsel for the respondent in the presence of both the parties who joined the proceeding through V.C. 8. This Court further interact with both of them and they submit that proceeding of both these petitions be closed, in view of the settlement as arrived between them and since both of them now get divorce by way of mutual consent pursuant to the judgment and decree dated 23.02.2026 and full and final payment towards alimony has already been paid this Court is of the view that for the end of justice proceedings of both the matter deserves to close. 9. In view of the compromise entered in between the parties dated 21.09.2025 and divorce decree dated 23.02.2026, both the petitions disposed of and impugned FIR dated 01.05.2023 bearing FIR No. 93 of 2023 registered at P.S. Dalanwala District Dehradun as well as the entire proceeding of Criminal Case No. 7534 of 2023 titled as State vs. Shaurya Gupta and other arising out of FIR dated 01.05.2023 is also hereby quashed.
