By way of the present petition filed under Section 482 of the Code of Criminal Procedure, 1973, the petitioners seek quashing of FIR No. 286/2020, registered at Police Station Kamla Market, Delhi, for the offences punishable under Sections 288/304A of the Indian Penal Code, 1860 (hereinafter referred to as the “IPC”), along with all consequential proceedings emanating therefrom, on the basis of a settlement arrived at between the parties. 3. Briefly stated, the present FIR came to be registered in relation to the accidental death of one Suresh Murmu on 15.12.2020 at a construction site. The prosecution case alleges that the said death occurred due to negligence attributable to the petitioners. Respondent Nos. 2 and 3 are the father and mother, respectively, of the deceased. 7. Learned counsel for the petitioners submits that the parties have amicably resolved all their disputes and have executed a Settlement Agreement dated 23.12.2022. It is submitted that the legal heirs of the deceased have received compensation and other financial assistance, and no grievance now survives against the petitioners. It is further submitted that Respondent Nos. 2 and 3 do not wish to pursue the criminal proceedings any further. 8. On a query made by this Court, Respondent Nos. 2 and 3, who have been duly identified by the Investigating Officer, state that they have entered into the settlement out of their own free will, without any force, coercion or undue influence. They further state that all disputes have been amicably resolved and that they have no objection if the present FIR and all proceedings emanating therefrom are quashed. 9. Considering the fact that the parties have amicably settled the matter, Respondent Nos. 2 and 3, being the parents and legal heirs of the deceased, have no objection to the quashing of the FIR, and keeping in view the peculiar facts and circumstances of the case, no useful purpose would be served by continuing the criminal proceedings.
