3. There is a delay of 385 days in filing the present appeal from order. The grounds shown in the delay condonation application are sufficient to condone the delay. Accordingly, the delay condonation application is allowed. The delay in filing the appeal from
order is hereby condoned.

The present appeal from order has been filed challenging the judgment and order dated 06.08.2022 passed by the learned Court of Employee’s Compensation Commissioner/ CJM, Pauri Garhwal in Employees Compensation Case No. 02 of 2021, ‘Uma Devi Vs. Garrison Engineer Lansdowne’, whereby, a sum of Rs. 15,62,670/ - was awarded in favour of the respondent.
5. Heard learned counsel for the parties and perused the record.

Learned counsel for the respondent has submitted that respondent has filed an execution for executing the award and during the execution proceedings, the matter was finally settled in the Lok Adalat on 09.09.2023, whereby the claimants as well as the appellant herein have settled their dispute for a sum of Rs. 21,89,109/ -. The said amount which was settled in the National Lok
Adalat was received by the respondent vide demand draft dated 18.08.2023.

Learned counsel for the appellant has submitted that the fact about the settlement of the dispute was not brought to his knowledge while drafting this appeal due to some inadvertence oversight.
8. Since, the matter has already been settled between the parties and the payment has already been received by the respondent, the present Appeal from Order is dismissed on this ground.
