Learned counsel for the petitioner submits that, though there is a relationship of husband and wife between the petitioner and Respondent No. 2, the learned Trial Court, while hearing the anticipatory bail application, allowed the same by giving the allegations of forgery and cheating committed by the accused persons a matrimonial colour. He further submits that the petitioner has been cheated by the respondents and that, merely because there is a matrimonial dispute between the parties, the offences of cheating and other such offences allegedly committed by the respondents against the This is a digitally signed order. He further submits that the FSL report also states that the signatures of the petitioner have been forged and therefore, the anticipatory bail granted to the respondents be cancelled. 3. Per contra, counsel for the respondent nos. 2 and 3 who has appeared through VC submits that even after the grant of anticipatory bail, respondents have complied with all the conditions of anticipatory bail and have joined the investigation as and when directed by the IO. Respondent no.3 is a senior citizen having retired from the Ministry of Defence and she along with Respondent no.2 has visited the police stations about 40 times till date and respondents have also given the specimen signatures to the IO. 4. Learned APP for the State has handed over the latest status report in the Court today. Let the same be taken on record. The relevant portion is stated below:- “ 6. That the bank transactions and financial trail connected with the allegations have been examined. Relevant documents, including bank account statements and other transaction records, have been obtained from the concerned banks and scrutinized during the course of investigation. The said documents are being considered along with the other evidence collected during the investigation. 7. That notices under Section 35 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (earlier Section 41A Cr.P.C.), wherever required, were served upon the accused persons. Pursuant thereto, the accused persons joined the investigation and their statements were recorded. 8. That the investigation conducted so far reveals that the allegations pertain to the alleged forgery of resignation documents and the consequential changes in the Directorship of the aforesaid companies. Present Status of Investigation: That the investigation is still in progress. The Forensic Science Laboratory Report has been received, the records obtained from the Registrar of Companies and the documents received from the concerned banks have also been examined. However, certain aspects of the investigation are still under examination and the entire evidence collected during the investigation is being evaluated so as to arrive at a fair, impartial and lawful conclusion. Upon completion of the investigation, an appropriate police report under Section 193 of the Bharatiya Nagarik Suraksha Sanita, 2023 shall be filed before the competent Court in accordance with law. 10.That the accused persons have been cooperating with the investigation and are complying with the conditions imposed while granting anticipatory bail. As and when required, they shall be called upon to join the investigation for the purpose of further inquiry.” 5. The anticipatory bail was granted to the accused in the year 2023. As per the report of the IO, respondents have fully complied with the conditions of the anticipatory bail and have joined the investigation as and when required to do. 6.
