By the way of the present petition the petitioner is seeking quashing of FIR No. 208/2017, registered at Police StationVasant Kunj, Delhi, for the offences punishable under Sections 307/323/34 of Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties. 3. Issue notice. The learned APP accepts notice on behalf of the State. 4. The petitioners and respondent no. 2 is present before this Court and the parties have been identified by the Investigating Officer concerned. 5. Briefly stated, the petitioners and respondent nos. 2 to 5 are residents of the same locality and certain disputes and differences arose between them This is a digitally signed order. The Order is downloaded from the DHC Server on 20/08/2026 at 11:00:19 in relation to an incident which took place on 16.05.2017. Pursuant thereto, FIR No. 208/2017 was registered at P.S. Vasant Kunj under Sections 307/323/34 of the Indian Penal Code, 1860, against the present petitioners. In respect of the same incident, a cross-FIR bearing No. 209/2017 was also registered at P.S. Vasant Kunj against the other side under Sections 308/323/34 IPC. The parties sustained injuries in the said incident and the matter was investigated by the police, whereafter the chargesheets were filed before the learned Trial Court. During the pendency of the proceedings arising out of the aforesaid FIRs, the parties were referred to the Delhi Mediation Centre, Patiala House Courts, Delhi, where they amicably and voluntarily resolved their disputes and entered into a Mediation Settlement dated 31.03.2023. 6. On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise, vide Settlement Agreement dated 31.03.2023, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed. 7. Respondent no. 2 further states that respondent no. 5 has since expired and that respondent nos. 3 and 4, being his mother and brother respectively, also have no objection to the quashing of the present FIR. 8. In view of the fact that the parties have amicably resolved all their dispute and the Respondents have no objection to the quashing of the FIR, no useful purpose would be served in continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.
