1. This writ petition seeks the following reliefs:
“I. To set aside & quash the Orders dated 28.07.2022 issued by Respondent No.3 acting as President of India & by which it has illegally placed the Petitioner under an illegal suspension from office of the Director of Respondent No.2 treating the Petitioner as an employee (Annexure P-1). II. To hold & declare the provisions of Article 32 of Articles of Association of M/s SJVN Ltd. (Annexure P-2) being void ab-initio ex-facie for being repugnant to section 252 r.w. section 166 of the Indian Companies Act, 1956 &also to the section 149 & 152 of the Indian Companies Act,
2013. III. To set aside & quash the provisions of para 1.16 of letter dated 10.03.2021 (Annexure P-3) issued by Respondent No.3 being in violation of This is a digitally signed order. the law, & the Corporate Veil. IV. To direct Respondent No.2 to treat the Petitioner to be in office of its Director for its intervening period commencing w.e.f. 28.07.2022 till the restoration of Petitioner to that office with all the consequences of holding the said office.”
2. The challenge in the present petition is to the order dated 28th July, 2022, whereby the Petitioner was placed under suspension. It is not in dispute that during the pendency of the disciplinary proceedings, the Petitioner attained the age of superannuation. Moreover, the Petitioner has already instituted a separate writ petition challenging the domestic inquiry initiated by the Respondents, including the Memorandum of Charges dated 31st January, 2023, and that the reliefs sought therein substantially overlap with the reliefs sought in the present petition, i.e., W.P.(C) 5849/2023. 3.
In view of the aforesaid developments, the relief sought in the present writ petition has been rendered infructuous.
