JUSTICE ADITYA KUMAR MOHAPATRA ORDER 01.05.2026 Order No. 06. 1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode). 2. Heard learned counsel for the Parties. 3. Learned counsel for the Opposite Party-Contemnor on the basis of the instruction dated 30.04.2026 from the office of Tahasildar (Sadar), Cuttack submitted before this Court that the office had expedite and the process submitted the case record before the Sub-Collector, Cuttack for necessary approval. However, the ADM, Cuttack vide his letter dated 17.02.2026 returned the case record with some objection. As per the objection no.3 “legal heir certificate of the deceased to be furnished in order to ascertain the right, title over the suit land”. It has also been mentioned in the said instruction that the Petitioner was Page 2 of 2. communicated to submit the required legal heir certificate for necessary compliance. It has also been stated that the Petitioner has expressed his inability to produce the required legal heir certificate. Further such instruction reveals that other objection has already been complied with in the meantime. In such view of the matter, it has been assured in the instruction that a record shall be placed before the Sub-Collector for approval. 4. In view of the aforesaid instruction, the contempt proceeding is dropped with liberty to the Petitioner to approach this Court to revive the same, in the event the cause of action still subsists.
