On the previous date, the following order had been passed:-
“Steps for service of respondent No.5 are being taken since
15.6.2023. The said proforma respondent had been held to be jointly and severely liable alongwith the present appellant. The said proforma respondent had been proceeded against ex parte before the trial Court. Let appropriate steps be taken within a period of two weeks for effecting service of the said proforma respondent No.5. If no steps are taken within the aforesaid period, then the matter shall be dismissed for non-prosecution without reference to this Court.”
By way of the present application, for the reasons mentioned therein, one more opportunity is being sought for effecting service of proforma respondent No.5. For the reasons mentioned in the application, the same is allowed. One opportunity by way of indulgence is afforded to the applicants/appellants for effecting service of proforma respondent No.5. Application stands disposed of.
CMP(M) No. 652 of 2023
Steps for effecting service shall be taken within a period of two weeks. On taking such steps, issue notice to the said proforma respondent, returnable within four weeks.
List thereafter.
It is made clear that if no steps are taken for effecting service of proforma respondent No.5, then the previous order shall automatically stand revived and the case at hand shall be dismissed for non-prosecution.
