2. The present petition under Section 25B (8) of the Delhi Rent Control Act, 1958, seeks the following prayers:-
“(i). To set aside the impugned order and judgment dated 17.07.2023, passed by passed by Ms. Pragati, Ld. Addi. Rent Controller, Central District, Tis Hazari Courts, Delhi, in case No. 29/2022, titled as, 'Mahavir Prasad Vs. Gopal Gupta'.
(ii). Any other or further order which this Hon'ble Court may deem fit and proper in the facts and circumstances of the case may be passed in favour of the petitioners and against the respondent.”

Learned counsel appearing on behalf of the petitioner submits that the matter is fixed before the learned ARC for the petitioner’s evidence and in view of the same seeks leave to withdraw the present petition, with a prayer for expeditious disposal.
