CMP No.9379 of 2026 The present application has been filed by the applicant/respondent for the release of amount, which stands deposited by the appellant/non-applicant in the Registry of this Court. The application is duly supported by an affidavit. Therefore, in view of the averments, as made in the application, and in view of no objection of the non-applicant, the present application is allowed and the amount deposited by the non-applicant, as measne profit in the Registry of this Court, is ordered to be released in favour of the applicant/respondent by remitting the same in his saving bank account, particulars whereof shall be furnished by learned counsel for the applicant/respondent during the course of the day. It is made clear that the release of said amount shall be subject to the final outcome of present appeal. The applicant/respondent shall file an undertaking before this Court that, in the event of any adverse order against him, he shall refund the said amount without any protest.
