Appeal under Section 96 read with Order XLI of the Code of Civil Procedure, 1908 (CPC) has been filed against the judgment dated 12.05.2023 whereby the Suit of the Plaintiff/Respondent has been decreed in the sum of Rs.3,11,363.86/- alongwith interest @ 9% p.a. w.e.f. 21.02.2014 till the date of recovery. 2. The only challenge to the Appeal is that the interest @ 9% has been directed to be compounded yearly, till recovery. Moreover, it is submitted that the rate of interest @ 9% p.a. is higher. Submissions heard. 3. It is a commercial transaction to which the recovery suit pertained. Therefore, the rate of interest at 9% p.a. cannot be faulted.
