Admittedly, the CRLMC was dismissed for default for non-appearance of the petitioner on 17.03.2023, 22.03.2023 and 13.04.2023, but since the matter has not been disposed of on merit and taking into account the averments of the CRLMA, this Court considers that the interest of justice would be best served if the proceeding in CRLMC is restored to file. 4. Accordingly, the CRLMA stands allowed and the proceeding in CRLMC No. 2069 of 2015 is restored to file. Registry is requested to take steps for listing of the matter before appropriate Bench. (G.
