Heard learned counsel appearing for the parties. 3. Even though the present Writ Petition has been filed inter alia challenging the order of punishment passed vide office order dated 08.02.2021 under Annexure-7 of Opp. Party No.1, while disposing the proceeding initiated against the petitioner vide Memorandum dated 02.03.2012, but in course of hearing, learned counsel for the petitioner contended that petitioner on self-same charges, faced a Vigilance Proceeding. Even though he was convicted in the Vigilance proceeding, but challenging such order of conviction and sentence, petitioner has moved this Court by filing CRLA No.590 of 2021. 3.1. It is accordingly contended that since the charges in both the proceedings are same, liberty be given to the petitioner to challenge the order impugned if the petitioner is acquitted ultimately by this Court in CRLA No.590 of 2021 and no challenge is made to the said order by the State before the Higher Forum. 4. Learned Addl. Govt. Advocate has no serious objection to the course of action proposed by the learned counsel for the petitioner. 5. Having heard learned counsel for the parties and considering the submission made, the Writ Petition stands disposed of with the liberty as prayer for. 6. The Writ Petition stands disposed of.
