-2- petitioner. 1,35,300/- tablets of tramadol and alprazolam were recovered from him, which were contained in a number of boxes containing a number of strips. The weight of the contraband came to 19 k.g. whereas, the commercial quantity for alprazolam is 100 grams and for tramadol, it is 250 grams. 4.
Learned counsel for the petitioner submits that the petitioner has been falsely implicated. He submits that in fact the contraband was planted upon the petitioner by the investigating agency. He further submits that the petitioner is in custody since 21.01.2024; almost 2 ½ years have gone by, final report has already been submitted; charges have already been framed and still 9 witnesses out of a total of 25 remain to be examined and trial will take a sufficiently long time. He submits that under the circumstances, no useful purpose would be served by keeping the petitioner in custody any longer.
5.
Per contra, learned counsel representing the State has opposed the bail petition stating that a huge quantity of contraband was recovered from the petitioner and in case he is released on bail, he may abscond.
6.
I have considered the submissions made by learned counsel for the parties.
7.
No doubt, the petitioner is in custody for the last almost 2½ years. However, out of a total of 25 witnesses, 16 already stand examined. Still further, the allegations are extremely serious as 19 k.g. of contraband is alleged to have been recovered from the petitioner, who was running a chemist stop in the name of some other person. This Court finds absolutely no reason to release the petitioner on bail merely because he is in custody for the last 2 ½ years.
8.
That being so, the petition is found to be devoid of merit and is accordingly dismissed.
