The present petition has been filed by the petitioner under Articles 226/227 of the Constitution of India, seeking a writ of certiorari, for quashing the order dated 13.10.2023 (Annexure P-11). Further, a writ of mandamus has been sought for staying the promotion of non-diploma holders to the post of AAE (Additional Assistant Engineer) or in the alternative keeping one promotional post of AAE vacant. 2. Learned counsel for the parties are ad idem that during the pendency of the present petition, the petitioner has been promoted as Additional Assistant Engineer, vide order dated 02.12.2024, therefore, the instant petition has been rendered infructuous. A copy of the order dated 02.12.2024 has been filed in the Court, which is taken on record. Learned counsel for the petitioner submits that the petitioner is entitled for promotion to the said post and his due seniority from the earlier date for which he shall make a detailed representation to the respondents and the same may be considered and disposed of in a time bound manner. 4. If any such representation is moved by the petitioner within a period of one month from today, the same shall be considered and disposed of by the competent authority by passing a speaking order on the same, within a period of three months thereafter. 5.
