IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 103 CWP-7193-2023 Date of Decision : July 17, 2026 VIJAY MASIH -PETITIONER V/S THE STATE OF PUNJAB AND OTHERS -RESPONDENTS
CORAM:
HON'BLE MR. JUSTICE KULDEEP TIWARI Present: Mr. Vijay K. Jindal, Advocate for the petitioner. Mr. Sahil R. Bakshi, A.A.G., Punjab. *** KULDEEP TIWARI, J. (ORAL)
1. Through the instant writ petition, the petitioner has assailed the legality and validity of the order dated 14.03.2023 passed by respondent No.2, primarily on the ground that the same is a non-speaking order bereft of any reasons.
2. Learned State counsel fairly concedes that the impugned order does not assign any reasons for declining the relief claimed by the petitioner. It is submitted that although the reply filed on behalf of the respondents before this Court sets out the reasons for rejection of the petitioner’s claim, the same cannot cure the inherent defect in the impugned
order arising from the absence of reasons.
3. On instructions received from Mr. Sukhjinder Singh, D.F.S.C., Amritsar, learned State counsel submits that the competent authority shall reconsider the petitioner’s claim and pass a fresh reasoned and speaking
order, after affording the petitioner adequate opportunity of hearing.

4. In view of the stand taken by learned State counsel, the impugned order dated 14.03.2023 is hereby set aside. The respondent No.2/competent authority is directed to reconsider the petitioner’s claim and pass a fresh reasoned and speaking order, after affording the petitioner due opportunity of hearing, within a period of eight weeks from the date of receipt of a certified copy of this order.
5. Liberty is reserved to the petitioner to seek revival of the writ petition in the event of non-compliance with the directions embodied in this
order.
6.
Disposed of accordingly.
