Learned counsel for the petitioner contended that the present petitioner has been falsely involved in this case being the sister of the co- accused namely, Simranjeet Singh who was previously employed with one Gurpreet Singh, however, his brother left the job and due to grudge against the petitioner’s brother, false case has been registered against the co- accused and the present petitioner; complainant namely Gurpal Singh was earlier an employee to Gurpreet Singh and is well acquainted with the said Gurpreet Singh and in support thereof has annexed photographs (Annexure P-2); 31 FIRs have been registered against the said Gurpreet Singh and in counter blast to the same, the present FIR has been registered against the petitioner; earlier a similarly situated FIR no.307 dated 03.12.2022 under Sections 406, 420, 120-B IPC was registered by another employee of said Gurpreet Singh, namely Bachhiter Singh and in that case, the petitioner was granted the concession of anticipatory bail by a Coordinate Bench of this Court vide order dated 20.08.2024 passed in CRM-M-27314-2024 and a quashing petition bearing CRM-M-44697- 2025 in the said FIR, is also pending for adjudication before this Court. In the present case, the petitioner has nothing to do with immigration firm and has been implicated in the present case, being the sister of co-accused namely, Simranjeet Singh who has differences with Gurpreet Singh; she has not received any amount in her account; except the present FIR there is no criminal case against the present petitioner and as such, prayed for grant of concession of anticipatory bail to her. 4. Notice of motion. 5. Ms. Komal Sidhu, Advocate has filed Memorandum of Appearance on behalf of complainants in Court today which is taken on record and contended that the present petitioner has been working with her brother Simranjeet Singh in his Immigration Firm and is involved in cheating the people in the name of sending them abroad. In the present case, the petitioner alongwith co-accused, despite of taking huge amount, has neither sent the complainants abroad nor returned their money. 6. In pursuance of advance notice, Mr.
Anup Singh, AAG, Punjab put in appearance and accepted notice on behalf of respondent-State and submitted that main allegation is against the brother of the present petitioner i.e. Simranjeet Singh; when the complainants approached the brother of the petitioner, she was present in his office and assured the complainants that they will arrange for visa and send them abroad. However, on a query posed by this Court, it is fairly admitted that no amount has been received by the present petitioner in her account. 7. Heard. 8. Taking into consideration the contentions of learned counsel for the parties, facts & circumstances of the present case and the role assigned to the present petitioner; evidence regarding her complicity and the
contentions raised by learned counsel for the petitioner that one of the complainants, namely Gurpal Singh, in the present case is an associate of Gurpreet Singh who was earlier employer of petitioner’s brother- Simranjeet Singh and in this regard, drew the attention of this Court towards photographs annexed with the paper book; earlier also a similarly situated case was registered against the present petitioner on the complaint of Bachhittar Singh who was also an employee of said Gurpreet Singh and in that case, the petitioner was granted the concession of anticipatory bail by a Coordinate Bench of this Court vide order dated 20.08.2024 passed in CRM-M-27314-2024; main allegations are against the co-accused namely Simranjeet Singh and petitioner has not received any amount in her account, hence, this Court finds merit in the present petition and as such, the petitioner is directed to join the investigation as and when required by Investigating Officer. In the event of her arrest, the petitioner shall be admitted to interim bail on furnishing of bail/surety bonds to the satisfaction of investigating/arresting Officer subject to the conditions as MAHAVIR SINGH 2026.07.20 17:07 I attest to the accuracy and authenticity of this order/ judgment
