It is argued by learned counsel for the petitioner that he has been falsely implicated in this case on which cannot be considered to be legally admissible in evidence. He was not named in the FIR. No specific overt act has been attributed to him. The victim had sustained injuries on his legs. He had left was admitted against medical advice on 17.03.2025. He got admitted to some private hospital and had left to discharge the same on 22.03.2025 in a stable condition. He was admitted again on the same day but left against advice and had passed away on the same day. As per the medical opinion 04 grievous and 01 simple injury had been sustained by him. There was no opinion as to these injuries being dangerous to life. The victim was HIV positive person and therefore, his conspirator in this case Davinder has been extended benefit of bail. Even the persons who had allegedly inflicted injuries on the person of the victim have also been extended benefit of bail including Su conspirator. Practically all the accused have been extended benefit of bail. His case is at parity with the case of Davinder and Sunny and as such he too deserves to be extended benefit of bail. No useful purpose would be served by his further incarceration. His involvement in other cases cannot be considered to be a reason for denying benefit of bail to him. He has been acquitted in some of these cases. It is, therefore, argued that he deserves to be released on bail. -2026 (O&M) 3
