Ranjita, learned counsel appearing on behalf of the petitioners and Mr. H. Samarjit, learned senior counsel and PP assisted by Mr. W. Niranjit, learned Dy. GA appearing on behalf of the respondents. [2] AB No. 40 of 2023 had been field by five petitioners and AB No. 39 of 2023 had been filed by two petitioners. The names of the particulars of the said seven petitioners are as under:-

[3] It may be noted that all the above named seven petitioners are accused persons in the FIR No. 161(8)2023 TBL PS U/S 448/427/380/325/384/34 IPC. [4] In AB No. 39 of 2023, an interim order was passed by this Court on 20-10-2023 granting interim bail to the effect that if the
AB No. 40 of 2023 & AB No. 39 of 2023 Page 5 present petitioners are arrested in connection with the aforesaid FIR, before the next date of hearing, they shall be released on bail on their furnishing a bail bond of Rs. 50,000/- (Rupees fifty thousand) only with one surety of the like amount to the satisfaction of the arresting authority. It was also directed that the petitioners should cooperate fully with the investigation in connection with the said FIR and that they should not leave the State without prior permission of the arresting authority. It has been submitted that the said interim
order is still continuing till today. [5] In AB No. 40 of 2023, an interim order was passed by this Court on 25-10-2023 granting similar interim bail in favour of the said five petitioners and the said interim order is also still continuing till today. [6] As directed earlier by this Court, Mr. H. Samarjit, learned senior counsel & PP placed before this Court an upto date report in connection with the said FIR case from the Officer In-charge, Thoubal Police Station dated 16-05-2026. At paragraph No. 6 and 8 of the said report, it is inter alia, stated that all the accused persons/petitioners after obtaining the interim pre-arrest bail appeared before the IO of the case on 23-11-2023 and all the accused persons were interrogated and their statements on
AB No. 40 of 2023 & AB No. 39 of 2023 Page 6 interrogation were recorded by the IO of the case. It has also been stated that all the accused persons are now cooperating with the investigation of the said FIR and no custodial interrogation is needed. [7] The learned counsel appearing for the petitioners submitted that as the IO of the case has already interrogated all the accused persons in connection with the said FIR and as all the accused persons/petitioners are fully cooperating with the investigation, which is clearly reflected in the report submitted by the O.C., Thoubal Police Station, the present Pre-arrest bail application can be disposed of by making absolute the earlier interim
order passed by this Court on 20-10-2023 and 25-10-2023. [8] Mr. H. Samarjit, learned senior counsel & PP fairly submitted that as a report have been submitted by the OC, Thoubal PS to the effect that the petitioners are fully cooperating with the investigation and as their custodial interrogation is not required, the present bail applications can be disposed of as prayed for by the
learned counsel appearing on behalf of the petitioners. [9] In view of the submission made above, both the AB No. 39 of 2023 and AB No. 40 of 2023 are disposed of by making absolute
AB No. 40 of 2023 & AB No. 39 of 2023 Page 7 the earlier interim order passed by this Court on 20-10-2023 and 25-10-2023. The connected misc. case also stands closed. JUDGE Dhakeshori
