209 Sukhvir Singh ...... Petitioner versus Financial Commissioner (Appeals), Punjab & ors. ..... Respondents CORAM : HON'BLE MR.JUSTICE PANKAJ JAIN *** Present :- Mr. S.K.Arora , Advocate for the petitioner. Mr. H.P.S.Ishar, Addl. A.G., Punjab. Mr. Kanwaljeet Singh Brar, Advocate for respondent No.4. *** PANKAJ JAIN, J. (ORAL) Present writ petition has been filed impugning order dated 29.05.2023 (Annexure P-5) passed by Financial Commissioner (Appeals), Punjab. 2 The controversy involved in the present writ petition involves the appointment to the office of Lambardar. Vide impugned order, the Financial Commissioner (Appeals), Punjab remanded the matter back to be decided afresh by District Collector, Faridkot after assessing the comparative merits of the candidates and after affording equal opportunity to both the parties. The factor that weighed with the Financial Commissioner POOJA SHARMA 2026.07.10 14:35 I attest to the accuracy and integrity of this document (Appeals) is regarding the residence of the present petitioner. This Court on 18.02.2026 passed the following order :- “Learned counsel for the petitioner seeks an accommodation to place on record certain documents, including the passport of the petitioner as well as electricity bill of the house which is depicted in the photograph (Annexure P- 9), in order to substantiate that he is residing in the village to which the Lambardari belongs. At his request, adjourned to 16.04.2026.” 3 Counsel for the petitioner submits that even if in the passport the address of the petitioner is of Faridkot and not of the village there is ample evidence on record to prove his residence in village Marahar, Tehsil & District, Faridkot. 4 Keeping in view the nature of the controversy, this Court finds no ground to interfere with the impugned order. However, the impugned order is modified to the extent that the concerned District Collector shall decide the matter afresh, in accordance with law, within a period of three months from the date of receipt of this order. 5 Petition stands disposed off.
