For Petitioner : Mr.A.D.Ganeshamoorthi For Respondent : Mr.Y.Jegadeesh ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.3607 of 2023 O R D E R The present Writ Petition has been filed seeking for a direction to the respondent to release the 8 sovereign gold jewels and balance amount to me which is held in jewel loan Account No.2028002817 based on the petitioner's representation dated 11.01.2023, within the time limit that may be stipulated by this Court. 2.Learned Counsel for the petitioner would submit that the petitioner's mother pledged 8 sovereigns of gold jewels on 11.10.2018 with the respondent bank. However, the entire amount was paid subsequently. Thereafter, the petitioner's mother died on 24.11.2018. While so, when the petitioner approached the respondent bank, the respondent bank refused to release the jewels and savings amount, despite production of relevant documents before the Bank. In this regard, the petitioner sent a representation to the respondent bank on 11.01.2023. The said representation is still pending consideration. Hence, the present Writ Petition. 3.Learned Counsel appearing for the respondent bank would submit that if all the legal heirs of the deceased mother Saroja, then the jewels ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.3607 of 2023 and the savings amount will be released in favour of the legal heirs by the respondent Bank. 4.Heard the learned Counsel on either side and perused the materials available on record. 5.Considering the limited scope of the prayer sought for in this Writ Petition, this Court directs the petitioner to approach the respondent bank along with other legal heirs of the said Saroja and on appearance of all the legal heirs of the said Saroja, the respondent Bank is directed to release the jewels which were pledged by Saroja and the savings amount to the legal heirs of Saroja, immediately. 6.Accordingly, this Writ Petition stands disposed of.
