The instant petition has been filed by the petitioners claiming the following reliefs: - “i) To issue a writ, order or direction especially in the nature of mandamus or any other appropriate writ, order to direct the respondents to grant the following halted benefits of the petitioner/retired employees by implementing the order dated 11.02.2022 (Annexure P-3): - a) 5% interim relief from date of discontinuance i.e. 01.04.2018 till date of retirement of the petitioners. b) annual increments from date of discontinuance i.e. 01.04.2018 till date of their retirement. AND/OR ii) To issue a writ, order or direction especially in the nature of mandamus or any other appropriate writ, order for directing the respondents to bring into effect the order dated 11.02.2022 (Annexure P-3) and order dated 04.04.2022 (Annexure P-5), for the benefit of petitioners/retired employees by keeping in view the facts i) that the said order dated 11.02.2022 (Annexure P-3) has already been implemented for the existing employees of respondent organisation, ii) that the petitioners are equally entitled to the benefit of said order, as while in service, they have equally suffered with the halt of said benefits, iii) that vide order dated 11.02.2022 (Annexure P-3), order dated 04.04.2022 (Annexure P-5), and order dated 11.03.2022 (Annexure P-6) respondent has promised the implementation of restoration order on petitioners, which has not been executed till date, iv) that the petitioners, being retirees of respondent organisation, are finding it difficult to meet their financial ends as the halted benefits would have impacted their all post retirement income in a positive way, v) that differentiating between existing employees and employees those have been retired, on the pretext of restoration of benefits is unjustified and unreasonable as both the said employees are equally entitled to the benefit of said restoration order.” RAVINDER SINGH 2026.07.09 18:41 I attest to the accuracy and authenticity of this order/judgment -3- CWP-1752 of 2023 2. Learned counsel for the petitioners submits that the claim of the petitioners for grant of 5% interim relief from the date of discontinuance i.e. 01.04.2018 till the date of retirement of the petitioners and annual increments w.e.f. 01.04.2018 till the date of retirement of their retirement has already been granted to the petitioners and for the remaining reliefs, petitioners may be given liberty to submit a detailed representation to respondent No.3 and the same be considered in a time-bound manner. 3. Learned counsel for respondents No.3 and 4 has no objection to the prayer made by learned counsel for the petitioners. 4. If any such representation is submitted by the petitioners within a period of four weeks from today, the same shall be considered and disposed of by the competent authority within a period of three months from the date of its receipt. 5.
