The parties have entered into a compromise and a joint memorandum of compromise has been filed by both the parties. The joint compromise memo reads as follows: (i)The Appellant/husband filed petition for divorce under section 13(l)(ia) of the Hindu Marriage Act, 1955 against the respondent for dissolution of marriage solemnized on 07.04.2021. (ii)The parties have been living separately since 2022 due to misunderstanding and there is no mutual meeting ground for them to resume co-habitation. (iii)The parties have decided to end the marriage and the respondent wife is willing to grant divorce sought for by the appellant herein. There being no child born of the marriage. (iv)The respondent further submits that she will not have any claim for maintenance, alimony or any other claim arising out of the past relationship as against the appellant herein, as the appellant has paid a consolidated sum of Rs.5.00 lakhs (Rupees Five Lakhs only) to the respondent wife which payment is acknowledged by the respondent https://www.mhc.tn.gov.in/judis CMA No. 2760 of 2023 __________ Page3 of 5 (v)The respondent and appellant have mutually agreed to end the marriage and lead their respective independent lives. 3. The civil miscellaneous appeal is decreed in terms of the compromise and the marriage between the parties is dissolved. The joint compromise memo is taken on file and shall form part of the decree.
