IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH 125 FAO-2158-2023
DATE OF DECISION: 07.07.2026 KULDEEP KAUR AND ANOTHER
… Appellants Versus MALKIT SINGH AND OTHERS ... Respondents CORAM:
HON’BLE MR. JUSTICE DEEPAK GUPTA Present: Mr. N.K. Manchanda, Advocate for the appellants. **** DEEPAK GUPTA
, J. (ORAL)
1. The only ground to assail the award dated 07.01.2023 passed by the learned Tribunal in order to claim enhancement is that deceased Balbir Singh was a driver and therefore, his notional income should not have been taken on the basis of minimum wages.
2. However, it is conceded by learned counsel for the appellants on specific query that no evidence was produced to the effect that deceased was a driver. Once it is so, the Tribunal did not commit any error in considering the notional income of the deceased on the basis of minimum wages, in the absence of any cogent proof regarding his actual working.
3. No merits. Dismissed.
