For Petitioner : Mr.D.Jebaraj For Respondent : Mr.K.Guhan ORDER This writ petition has been filed to challenge the impugned order dated 08.02.2023 in I.A.No. 1 of 2022 in I.D.No. 68 of 2020 on the file of the Labour Court, Tirunelveli. 2. The learned counsel appearing for the petitioner would submit that the respondent Union filed I.A. No.1 of 2022 in I.D. No.68 of 2020 seeking to restrain the petitioner Corporation from engaging a practising Advocate to represent it in the industrial dispute. The said interlocutory application was dismissed by the Labour Court. However, while dismissing the application, the Labour Court directed the petitioner Corporation to pay a sum of Rs.2,500/- per month towards the legal expenses of the legal practitioner, if any, engaged by the respondent Union. Aggrieved by the said direction imposing costs, the present writ petition has been filed. 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.22203 of 2023 4. The learned counsel appearing for the respondent Union would submit that the respondent Union is not interested in receiving the amount directed to be paid by the petitioner Corporation towards legal expenses. 5. In view of the above submission made by the learned counsel appearing for the respondent Union, the direction contained in the impugned order dated 08.02.2023 in I.A. No.1 of 2022 in I.D. No.68 of 2020, insofar as it directs the petitioner Corporation to pay a sum of Rs.2,500/- per month towards the legal expenses of the respondent Union, is set aside. The Labour Court, Tirunelveli, is directed to dispose of I.D. No.68 of 2020 on its own merits and in accordance with law, as expeditiously as possible, preferably within a period of six (6) months from the date of receipt of a copy of this order. 6. With the above direction, this writ petition is allowed to the extent indicated above. No costs.
