ORDER This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to consider the petitioner's representation dated 17.04.2023 within a time frame to be fixed by this Court.
2. Heard the learned counsel on either side.
3. The case of the petitioner is that the petitioner's sons have failed to maintain and take care of the petitioner and her daughter. According to the petitioner, the second respondent is in occupation of the subject property. Therefore, the petitioner submitted a representation dated 17.04.2023 before the first respondent seeking eviction of the second respondent from the subject house and restoration of possession to the petitioner by invoking the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. Since no action has been taken on the said representation, the petitioner has approached this Court by filing the present writ petition. 2/4 https://www.mhc.tn.gov.in/judis

4. The learned counsel for State appearing for the respondents submitted that if the petitioner's representation has not already been considered, the same will be considered on its own merits and in accordance with law within the time stipulated by this Court.
5. In view of the limited relief sought for by the petitioner, without expressing any opinion on the merits of the claim, this Court directs the first respondent to consider the petitioner's representation dated 17.04.2023, if it has not already been considered, and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to all the necessary parties, within a period of six (6) weeks from the date of receipt of a copy of this
order.
