The present writ petition in W.P.(MD)No.20786 of 2023 was filed for issuance of a Writ of Mandamus to appoint a retired Honourable High Court Judge to monitor the eviction proceedings by the respondents in their lands situated at Adangarkulam, Palavur, Melekadambankulam South Valliyur, North Valliyur, Thanakkarkulam, Madhaganeri, Aavaraikulam, Soundraligapuram, Irrukandurai No.I, II, Shanmugapuram, Ooralvaimili, Alaganeri, Kilakulam, Pillaiyarkudiruppu, Sempikulam in Radhapuram Taluk, Thirunelveli District following order of this Court in C.R.P.(MD).No.1697 of 2014 dated 16.12.2021, W.P.(MD).No.21518 of 2019 dated 28.04.2023, 4325 of 2022 dated 11.03.2022 and W.P.(MD).No.8698 of 2023. 3.This Court passed series of interim orders in the writ petitions. In one 4/27 https://www.mhc.tn.gov.in/judis W.P.(MD)Nos.19642 and 20786 of 2023 such order Hon'ble Justice Mr.Ramanathan (Retired) and Hon'ble Mr.Justice A.Selvam (Retired) were appointed as Judge Commissioners. The Judge Commissioners had filed reports and the sum and substance of the reports are as under: i. The management of lands by Adhinam is in total mess and the same is attributable to the Adhinam officials and the lessees. ii. All the records are at the Central Office of the Adhinam at Chennai. Hence the Judge Commissioner ought to rely on the revenue records alone. In effect the Adhinam is not having any records at local office. iii. The lessees had sublet the lease to other persons which the Adhinam is not aware of. In the Adhinam records original lessee’s name would have been entered but on ground someone was in possession of the lands. iv. In some cases the cultivating tenancy rights were transferred. v. In some cases the cultivating tenancy rights were transferred along 5/27 https://www.mhc.tn.gov.in/judis W.P.(MD)Nos.19642 and 20786 of 2023 with land to some persons for huge sum which runs in lakhs. 4. As far as fixation of lease rent is concerned, the Judge Commissioners stated that the Adhinam had proposed rate for fixation, which the lessees are not accepting stating it as huge. Likewise, the lessees had proposed rate for fixation, which the Adhinam is not accepting stating the rate is less. The Judge Commissioners had stated that the government rates are more than the proposed rates by Adhinam. It is further stated that 20 to 30 persons who claimed to have representing the villagers had vehemently demanded to fix lesser amount. Based on this attitude of the lessees, the Adhinam could not collect the rent from the lessees all these years, hence the Adhinam pleaded that Adhinam may be permitted to collect advance lease amount calculating for 10 years period. Also pleaded that the lessees may be directed to pay the arrears amount. At this juncture, the Learned Counsel appearing for the lessees submitted that the Adhinam had collected some huge amount under the guise of “pathakanikai” or “subscription”, hence the same ought to be taken into account. The Learned Counsel appearing for the Adhinam had admitted that some money had been collected and they had issued receipt to the same. The government rate for the house was Rs.4,000/- in the year 1998, but now it is increased to four times i.e. Rs.20,000/-. Likewise for agricultural land also there was four times steep hike from the existing rates. The Judge Commissioners had stated that the Adhinam and Lessees had suggested the rate of lease rent, but both are not agreeing for the rates stated by either party. Further the Judge Commissioners had suggested rate of lease amount and the same was not agreed by both the parties. The following are the rates suggested by the Adhinam, Lessees and Judge Commissioner and after considering the same the last column is the rate fixed by this Court. As far as advance amount is concerned the same is refundable. But if there is any default the same shall be adjusted in the advance amount. Further the Adhinam suggested Rs.10,000/- per/cent for five years for house sites. And Rs. 75,000/- per/acre for five years. But the Lessees suggested Rs.6,000/- per/cent for five years for house sites. And Rs.60,000/- per/acre for five years. 7. Further the Adhinam submitted that they may be permitted to collect arrears of rent. 8. Based on the aforesaid reports and submissions this Court is issuing the following orders: a. The Adhinam shall maintain copy of the records locally. b. In the lease agreement the lessee is restrained from subletting the property, also restrained from transfer of tenancy rights, transfer of lease land, mortgage or in any way encumbering the property. The same shall be strictly adhered to. The rates for house sites are fixed as Rs.350/- per/cent per year and for agricultural lands at Rs.2250/- per/acre per year. The lease rent shall be increased at 15% percent once in every three years. d. As far as advance amount is concerned this Court is fixing the same as follows: i. If the lessee/occupant is in possession of house sites below 10 cents, the advance amount payable is Rs.7,000/- per/cent for five years. ii. If the lessee/occupant is in possession of house sites above 10 cents, the advance amount payable is Rs.10,000/- per/cent for five years. iii. If the lessee/occupant is in possession of house sites below 10 cents, the advance amount payable is Rs.3,000/- per/cent for six years. ii. If the lessee/occupant is in possession of house sites above 10 cents, the advance amount payable is Rs.5,000/- per/cent for six years. iii.
