Heard the learned counsel for the parties. Since no adverse order is going to be passed, notice to the respondents 2 to 4 is dispensed with. 3. The learned counsel appearing for the petitioner would submit that the first respondent, without taking into consideration the obligation of the respondents 3 and 4, who are also the children of the second respondent, fixed the entire maintenance liability on the petitioner by directing him to pay a sum of Rs.6,000/- per month to the second respondent. 2/5 https://www.mhc.tn.gov.in/judis W.P(MD)No.22865 of 2023 4. A perusal of the records reveals that the petitioner's father had executed a settlement deed in favour of the petitioner in respect of a residential house. It is also seen that the petitioner has taken over the management of the limestone manufacturing unit from his father. In such circumstances, the direction issued by the first respondent requiring the petitioner to pay a sum of Rs.6,000/- per month towards the maintenance of the second respondent cannot be said to be excessive or arbitrary. The petitioner, being one of the children of the second respondent, is under a statutory obligation to maintain his parent. Therefore, this Court finds no infirmity in the order passed by the first respondent warranting interference under Article 226 of the Constitution of India. 5. With the above direction, this writ petition stands dismissed. No costs.
