2 213 CRM-M-26647-2026(O&M) recovery. It is argued that the petitioner is in custody since 26.12.2025 and has already undergone an actual custody of nearly 05 months. Further, the investigation in the present case is complete, however, the charge has not been framed so far and that there are as many as 30 witnesses cited by the prosecution, hence, the trial is likely to take a long time to conclude. 3. Learned State Counsel does not dispute the aforesaid facts. 4. I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended along with the present petition. 5. Taking into consideration that the disclosure of co-accused links the petitioner only to the recovery of poppy-husk which is of intermediate quantity and not to the recovery of opium which was of commercial quantity recovered from the co-accused Dalvir Singh and Simrandeep Singh and considering that there would be arguable issues with respect to admissibility of the disclosure and its scope vis-à-vis the petitioner herein coupled with his clean antecedents, the period of custody already undergone by him as well as the stage of trial, I deem it appropriate to allow the present petition. 6.
6. The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned. 7. It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.
