IN THE HIGH COURT OF ORISSA AT CUTTACK W.P(C) No. 19952 of 2023 Manjulata Sethi …. Petitioner Mr. R. Mohanty, Advocate -versus- Annapurna Malik …. Opp. Party CORAM: THE HON’BLE MR. JUSTICE CHITTARANJAN DASH Order No. ORDER 19.03.2026 01. 1. By means of this application, the Petitioner seeks the following relief:- “In this circumstances it is therefore prayed that this Hon’ble Court may graciously be pleased to admit this writ application and issue notice under Rule NISI calling upon the Opp. party as to why the order dated 19.05.2023 under Annexure-5 passed by the Learned Civil Judge, (Junior Division) Kendrapara in Election petition No. 2 of 2022 shall not be quashed and the issues shall not be framed according to the provision U/s 35(3) of G.P. Act for the interest of justice.” 2. As seen from the case record, the matter was brought before this Court in the year 2023. The defect pointed out by the Stamp Reporter has not been removed as of yet. 3. Keeping in view the nature of prayer and in the absence of any interim order, the matter must have been proceeded by the learned Civil Judge, (Junior Division) Kendrapara-cum-Election Tribunal, Kendrapara in seisin over the matter and rendering the present application infructuous. Nevertheless, in the event, the matter is still pending before the learned Civil Judge, it may be disposed of as expeditiously as possible in accordance with law. In view of the above, the Writ Petition stands disposed of. (Chittaranjan Dash) Judge Sarbani Designation: Junior Stenographer
