For Petitioner : Mr.R.Mathavaselvam For Respondents 1 & 2 : Mrs.K.R.Shivashankari Counsel for the State of Tamil Nadu For Respondent No.3 : Ms.V.Kirthiga for M/s.APN Law Associates O R D E R The present Writ Petition has been filed challenging the impugned proceedings of the second respondent in Moo.Mu.No.5366/2022/J dated 13.01.2023 and for a consequential direction to the second respondent not to take any coercive steps against the petitioner and her son. 2.Learned Counsel for the petitioner would submit that the petitioner is the son of the third and fourth respondents. The third respondent father, had filed a petition before the second respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. However, the second respondent had passed an order dated 13.01.2023, whereby he directed the petitioner to pay a sum of Rs.5,000/- as monthly maintenance to the ____________ https://www.mhc.tn.gov.in/judis W.P.(MD)No.16927 of 2023 third respondent, without hearing the petitioner. Hence, the present Writ Petition. 3.Learned State Counsel appearing for the official respondents would submit that it is the duty of the children to take care of the parents and the third respondent, being the petitioner's father, the petitioner has to necessarily maintain the third respondent. Learned Counsel would further submit that the maintenance amount ordered by the second respondent is a reasonable one and accordingly, prays for appropriate orders. 4.Heard the learned Counsel on either side. 5.Admittedly, in the present case, the petitioner is the son of the third respondent and the third respondent had made a petition before the second respondent under Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The second respondent vide the impugned order dated 13.01.2023, had ordered for a monthly maintenance of Rs.5,000/-, which in the considered opinion of this Court is a just and reasonable amount.
