The custody certificate dated 16.05.2026, filed by the learned State counsel is taken on record. As per the same, the petitioner is behind bars for 3 months and 24 days.

Learned State counsel opposes the bail on the ground that there are specific allegations against the petitioner of having received bribe of Rs.1 lakh with regard to clearance of file of plots. However, she is unable to controvert the submissions with regard to stage of the case and the petitioner being not involved in any other case.

Considering the facts and circumstances of the case and the
submissions made on behalf of the petitioner, in particular she being in custody for the last 3 months and 24 days; not involved in any other case; hallan stands presented on 19.03.2026, but charges have not been framed and there are total 13 PWs; the trial is likely to take a considerable time and further incarceration of the petitioner would be violative of her right enshrined under Article 21 of the Constitution of India, thus the present petition is allowed.

The petitioner is ordered to be released on regular bail on her furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.

It is made abundantly clear that in case there is any breach of the aforesaid conditions, the State shall be at liberty to seek cancellation of bail as granted to the petitioner by this order.
