At this juncture, the learned counsel appearing for the petitioners sought permission to withdraw the present Writ Petition with liberty to avail the said statutory remedy. 3. In view of the above submission, this Writ Petition stands dismissed as withdrawn. Liberty is granted to the petitioners to file a Civil Miscellaneous Appeal under Section 30 of the Employees' Compensation Act, 1923, if so advised. The claimant is permitted to withdraw the balance amount deposited by the petitioners without filing any formal application before the concerned forum. However, such withdrawal shall be subject to the result of the Civil Miscellaneous Appeal, if any, to be filed by the petitioners. No costs.
