Chakkaravarthy, (for R2 to R5) Government Pleader ORDER This Writ Petition has been filed seeking a direction to the respondents to consider the petitioner’s representation dated 03.04.2023 within a time frame to be fixed by this Court and to take appropriate action to remove the names of the deceased and ineligible persons from the voters’ list of the as members of the Maduranthagam Co-operative Sugar Mills (MCSM), prepare the updated voters’ list, and conduct the election in a fair and proper manner and in accordance with law. 2. The grievance of the Petitioner, who is the Secretary of the Petitioner’s Association, is that he submitted a representation dated 03.04.2023, requesting the respondents to remove the ineligible persons from the voters’ list of the Society. https://www.mhc.tn.gov.in/judis WP No. 30629 of 2023 __________ Page3 of 6 3. This Court, by order dated 11.12.2023 passed the following order:- “ During the earlier hearing on 29.11.2023, it had been informed that only after the Co-operative Society of the Third Respondent sends the list of its eligible members, the First Respondent would be in a position to publish the voters’ list for conduct of the election as sought by the Petitioner in the Writ Petition. 2. Learned Counsel for the Petitioner seeks time to follow up the matter with the Third Respondent to ascertain as to whether the said list of its eligible members has been sent to the First Respondent. 3. The Third Respondent shall file report of the action taken on sending the voters’ list to the First Respondent for conduct of election of its Board of Directors before the next hearing. Post the matter on 19.12.2023.” 4. The third respondent has filed a Status Report, dated 07.02.2025. The relevant portion of the said Status Report reads as follows:- “ 7. I submit that as per the Letter in Na.Ka.1070/2023.Ko.The.1, dated 04.01.2024 issued by the 1st Respondent, this respondent mill is also taking steps to collect the Aadhar and Smart (Ration) Card and linking the same with the eligible members and our mill is taking all the effective and speedy steps to finalize the eligible member list. 8. I submit that in compliance to the order of this Hon’ble Court order 11.12.2023, this respondent https://www.mhc.tn.gov.in/judis WP No. 30629 of 2023 __________ Page4 of 6 have received a communication from the 5th respondent office vide Ne.Mu.Ka.No.10159/2022/tha(ma) Aa, dated 07.01.2025 to furnish the list of the members of this respondent Mill and this respondent vide R.C.No.C1/0391/COE/2023 dated 18.01.2025, this respondent had forwarded the list of the members totally 24544 members as on 30.11.2024. 9. I humbly submit that this respondent is taking several steps to link the aadhar and ration card with the member’s ID and also taking necessary steps to identify the dead person from the list to delete their membership and the same is under process.” 5. In view of the ongoing process being undertaken by the third respondent, no further order is required to be passed in this Writ Petition. 6. Accordingly, this Writ Petition stands disposed of.
