The petitioner filed this application along with an affidavit dated 11.01.2023, categorically stating that he has remained completely unemployed and has not been gainfully employed anywhere since the date of his termination. Though more than three and a half years have elapsed since the filing of this petition, the respondent/management has chosen not to file any counter-affidavit to rebut the specific claim of the petitioner regarding his lack of gainful employment. Under these circumstances, the workman is legally entitled to the relief claimed. 3. Accordingly, this Writ Miscellaneous Petition is allowed. The respondent/management is directed to pay the petitioner the full last drawn wages from the date of filing of the main Writ Petition within a period of six(6) weeks from the date of receipt of a copy of this order and shall continue to pay the last drawn wages on or before the 7th day of every succeeding month until the final disposal of the main Writ Petition.
