Learned counsel for the petitioner submits that, as evident from the Shipping Bill Check List, the goods proposed to be exported are classifiable under Chapter Heading 3505 9090. It is further submitted that similar goods falling under the same tariff classification have earlier been exported without insisting upon a No Objection Certificate from the Department of Fertilizers, in terms of Notification No.49/2015-20 dated 07.01.2019. Therefore, according to the petitioner, no such NOC is required for the proposed export. 3.
