Learned counsel appearing on behalf of the petitioner contends that the petitioner has been falsely implicated in the present case. There is a delay of nearly 05 months in registration of the present case. The petitioner is in custody since 26.03.2025. The charges in the present case were framed on 02.01.2026. The petitioner has thus undergone an actual custody of 01 year and the evidence is yet to commence. She further contends that the case is triable by the Court of Magistrate. She submits that there are 12 witnesses cited by the prosecution which are yet to be examined and therefore conclusion of trial shall take a long time. It is further submitted that the petitioner has clean antecedents and he is around 51 years of age.

Learned State Counsel does not dispute the aforesaid facts.

I have heard counsel for the respective parties and have gone through the documents appended alongwith the present petition.

Taking into consideration the period of custody already undergone by the petitioner i.e. nearly 01 year in a magisterial trial which is yet to commence and the fact that no evidence has been recorded so far, I deem it appropriate to allow the present petition.

The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned.

It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly.

The observation made hereinabove shall not be construed as an expression on the merits of the case and the Trial Court shall decide the case on the basis of available material.
