SUNDAR (ORDER) 18.05.2026 Read this in conjunction with and in continuation of earlier proceedings made in the previous listing on 15.04.2026 which reads as follows: ‘15.04.2026 Captioned matter is listed under the cause list caption ‘SERVICE NOT COMPLETED’ Mr. L. Seityandra, learned counsel on record for ‘MC’ (‘Miscellaneous Case’) applicant and Mr. H. Dijen, learned counsel on record for respondent Nos. 1 & 2 are before this Court. This Court is informed that respondent No. 4 remains unserved. Fresh notice to respondent No. 4, returnable by 18.05.2026. Though captioned matter is listed under the cause-list caption ‘SERVICE NOT COMPLETED’, Mr. H. Dijen, learned counsel submits that a settlement (settlement in mediation proceedings) has been arrived at between the parties in a connected matter being RP(FAM.CT.) No. 1 of 2023 and one of the terms of settlement is the MC applicant would withdraw the captioned MC applications. While Mr. H. Dijen, learned counsel sought time to produce the afore-referred terms of settlement, Mr. L. Seityandra, learned counsel for MC applicant sought time for getting instructions regarding withdrawal, if that be so. List under the caption ‘FOR WITHDRAWAL OR COMPLETING SERVICE’ on 18.05.2026. List on 18.05.2026.’ Today, Mr. L. There is no representation for respondent Nos. 1 & 2 though the name of learned counsel on record for respondent Nos. 1 & 2 is duly shown in the cause-list. However, adverting to earlier proceedings dated 15.04.2026, Mr. L. Seityandra, learned counsel very fairly submitted that he is withdrawing the captioned MCs, saying so learned counsel has made an endorsement in the chat box and a scanned reproduction of the endorsement is as follows: As MC applicant is withdrawing the captioned MCs, presence of learned counsel for Respondent Nos. 1 & 2 is dispensed with.
