The petitioners’ mother is an accused in Crime No.46 of 2023 on the file of the third respondent registered for the offence under Section 381 of IPC. The entire stolen property lying in the locker belongs to the petitioners herein. Now the investigation is still pending in Crime No.46 of 2023. Though the petitioners are not accused in Crime No.46 of https://www.mhc.tn.gov.in/judis W.P.Nos.23425 & 23433 of 2023 2023, the entire crime proceeds kept in the locker belong to the petitioners herein. Therefore, the third respondent rightly made a request to the second respondent to freeze the petitioners’ locker in savings bank account Nos.724988123 & 725494213, respectively. While pending the investigation, the relief sought for in these petitions cannot be considered and both the petitions are liable to be dismissed. However, the third respondent is directed to complete the investigation in Crime No.46 of 2023 and to file a final report before the jurisdictional Court within a period of twelve weeks from the date of receipt of a copy of this Order. 3. Accordingly, both the Writ Petitions stand dismissed.
