Vijay Kumar Singh, learned counsel on record for revision petitioners and Mr. Dayali Elangbam, learned counsel for sole respondent are before this Court. After some arguments, counsel on record for revision petitioners Mr. Th. Mahira sought leave of this Court to withdraw the captioned CRP(Civil Revision Petition) but made a plea to preserve the rights and contentions of the revision petitioners to take out an interlocutory application in Trial Court with a prayer qua sole respondent seeking injunction against putting up further constructions (superstructures). Leave sought and request are acceded to. Permitted to withdraw and rights and contentions of revision petitioners are preserved to the limited extent indicated herein. If the revision petitioners take out an interlocutory application with an interim prayer qua sole respondent as regards putting up further constructions (superstructures), the same shall be considered on its own merits and in accordance with law by the Trial Court untrammeled by instant withdrawal. Rights of the revision petitioners are preserved to this limited extent. As regards main suit, though obvious, for the purpose of specificity it is made clear that the Trial Court shall proceed with the suit/trial on its own merits and in accordance with law untrammeled by withdrawal of captioned CRP. Captioned CRP is disposed of as withdrawn/closed albeit with limited preservation of rights in the aforesaid manner. There shall be no order as to costs.
