Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short “BNSS”), the petitioners FIR No.272 dated 19.12.2024 registered under 190 of the Bharatiya Nyaya Prayer in the present petition filed under Section 482 of bail to the petitioners in case FIR No.272 dated 19.12.2024 registered under Sections 331(6), 115(2), 324(4), 191(3) and 190 of the Bharatiya Nyaya that the petitioner has been falsely implicated in the present case. He argued that earlier, the petitioner was granted the concession of interim bail by the learned Sess and he was directed to join investigation within the stipulated period. However, the petitioner failed to comply with the said
order because he was implicated in another FIR No.94 of 2023. He argued that th Gurbhej Singh, which has been declared simple in nature. No recovery is to be effected from him. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and investigating agency. accepts notice on behalf of respondent file status report in the matter. investigation within a week from today and would appear as and when required by the Investigating Officer and cooperate with the Investigating Agency. In the event of arrest, he shall be admitted to interim bai satisfaction of Arresting/Investigating Officer. He argued that earlier, the petitioner was granted the concession of interim bail by the learned Sessions Judge, Faridkot, vide order dated 11.02.2026 and he was directed to join investigation within the stipulated period. However, the petitioner failed to comply with the said
order because he was implicated in another FIR No.94 of 2023. He argued that the main injury has been attributed to co Gurbhej Singh, which has been declared simple in nature. No recovery is to be effected from him. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and when called upon to do so by the investigating agency. Notice of motion. On asking of the Court, Mr. Amit Shukla, DAG, Punjab, accepts notice on behalf of respondent file status report in the matter. Adjourned to 24.03.2026. In the meantime, the petitioner is directed to join investigation within a week from today and would appear as and when required by the Investigating Officer and cooperate with the Investigating Agency. In the event of arrest, he shall be admitted to interim bail on furnishing of bail/surety bonds to the satisfaction of Arresting/Investigating Officer. The petitioner shall also abide by the conditions as envisaged under Section 482(2) of BNSS, 2023.”
