Although 255 grams of heroin was recovered from the possession of co-accused Jaswant Singh @ Jimmy, the said heroin had been supplied by the applicant-accused, Gagandeep Singh @ Gaggu. It is further alleged that the applicant-accused, Gagandeep Singh @ Gaggu, is running a network from within the jail itself, and accordingly, he has supplied the heroin in question to co-accused Jaswant Singh @ Jimmy. 4. Learned counsel appearing on behalf of the petitioner contends that recovery of 255 grams of heroin had been effected from co-accused Badal and Jaswant Singh @ Jimmy and that the petitioner has been nominated as an accused on the disclosure statement of the said co-accused. She further contends that the petitioner was already in custody at the time of the abovesaid recovery and there is no manner in which the petitioner may be linked to the said recovery. No recovery pursuant to the disclosure has been effected from the petitioner. She further contends that the petitioner is in custody in the present case since 13.04.2025. There are total 17 witnesses cited by the prosecution and that the trial has not yet commenced since charges have not been framed. 5. Learned State Counsel contends that the petitioner is a history- sheeter and is involved in as many as 22 FIRs. He however fairly concedes that in 10 FIRs, the petitioner herein already stands acquitted. It is also conceded by him that the petitioner was already in custody in relation to the other FIRs and that his nomination in the present case is on the basis of disclosure statement of the co-accused from whom recovery had been effected. The stage of the trial as well as the period of custody already undergone by the petitioner is also not disputed. 5. I have heard learned counsel appearing on behalf of the respective parties and have gone through the documents appended along with the present petition. 6. Taking into consideration the period of custody already undergone by the petitioner, the nature of allegations levelled, absence of recovery as well as the stage of trial, I deem it appropriate to allow the present petition. 7. The instant petition is allowed and the petitioner is ordered to be released on regular bail on his furnishing requisite bail bond/surety bond to the satisfaction of the trial Court/Duty Magistrate, concerned. 8. It is made clear that the petitioner shall not extend any threat and shall not influence any prosecution witnesses in any manner directly or indirectly. 9. The observation made hereinabove shall not be construed as an expression on the merits of the case and the Trial Court shall decide the case on the basis of available material. 10.
