Through the instant petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (For short “BNSS”), the FIR No.305 dated 29.06.2025 1 of the Bharatiya Nyaya Sanhita, Prayer in the present petition filed under Section 482 of the BNSS, 2023 is for grant of anticipatory bail to the petitioner in case FIR No.305 dated 29.06.2025 registered under Section GURPREET 2026.02.05 09:39 I attest to the accuracy and authenticity of this document. Learned counsel for the petitioner has contended that the petitioner has been falsely implicated in the case. In fact, the petitioner and his family himself are the victims at the hands of the Company namely R.G. Immigr petitioner was deceived and defrauded by the said Company to the tune of Rs.30,35,000/-, for which, on the complaint of the wife of the petitioner, FIR No.83 dated 09.02.2025 under Sections 326(2), 318(4), 61(2) BNS of 2023 and Se of the Immigration Act was lodged at Police Station Ladwa, District Kurukshetra (Annexure P3) i.e. about four months prior to the registration of the FIR in question. Further, it is argued that in the initial complaint dated 18.12.2024 (Annexure P-4), made to SHO, Police Station Phase-I, Mohali, the complainant had not named the petitioner. Even in the second complaint dated 21.03.2025 (Annexure P made at Kurukshetra, no allegations were made against the petitioner, at the initial stage. It that the name of the petitioner was added as an accused, which raises doubts about the truthfulness of the complaint. It is further the case of the petitioner that the complainant in the present case is known to the petitio college days and it was on the asking of the complainant that the petitioner told him about his own plans of going abroad for work. The complainant also desired to go abroad on work visa and then the petitioner told him about the company R.G. Immigration Services. The complainant approached the said Company on his own and executed an agreement with the said Company for a total amount of Rs.12 lacs, out of which Rs.9 lacs were paid through RTGS directly in the account of the Company. The Company asked for remaining amount of Rs.3 lacs in cash, which the complainant did not have. Learned counsel for the petitioner has contended that the petitioner has been falsely implicated in the case. In fact, the petitioner and his family himself are the victims at the hands of the Company namely R.G. Immigration/Rudraksh Group. The petitioner was deceived and defrauded by the said Company to , for which, on the complaint of the wife of the petitioner, FIR No.83 dated 09.02.2025 under Sections 326(2), 318(4), 61(2) BNS of 2023 and Sections 10/24 of the Immigration Act was lodged at Police Station Ladwa, District Kurukshetra (Annexure P3) i.e. about four months prior to the registration of the FIR in question. Learned counsel for the complainant, while opposing the petition for anticipatory bail, has contended that the petitioner in connivance with other co-accused has committed a fraud by usurping the hard-earned money of the complainant and, thus, does not deserve the concession of bail. In the meantime, the petitioner investigation within a week from today and would appear as and when required by the Investigating Officer and cooperate with the Investigating Agency. In the event of arrest, he shall be admitted to interim bail on furnishing of bail/s the satisfaction of Arresting/Investigating Officer. Learned counsel for the petitioner submits that in compliance of the order dated 22.08.2025 passed by this Court, the petitioner has joined the investigation. -3- his request, the petitioner deposited the said amount in the Company and on return deposited Rs.3 lacs in the account of the petitioner. Learned counsel has also referred to the receipt of cash deposit dated 19.11.2024 (Annexure P-7). Further, it is submitted that Sachin, relative of the complainant was also not having cash amount of Rs.6 lacs, and thus, to help him, this amount was deposited by the petitioner on 15.10.2024. It was this amount, which was returned by Sachin by way of RTGS to the petitioner. Learned counsel has further submitted that the petitioner is ready and willing to join the investigation as and when called upon to do so by the investigating agency.
